1. Acceptance of Terms

By accessing, using, or interacting with any of the following systems operated by Team Summit, you hereby agree to be legally bound by these Terms of Service in their entirety:

  • The Team Summit Discord server and any affiliated or managed Discord servers
  • Spectra Bot, including all commands, automations, moderation systems, logging mechanisms, and background processes
  • The Team Summit website (summitgg.org) and all associated web properties
  • Any APIs, dashboards, integrations, or backend services operated by Team Summit
  • Any future tools, bots, services, or platforms released under the Team Summit brand

Mandatory Acceptance

Use of any single component listed above constitutes full and unconditional acceptance of these Terms. If you do not agree to these Terms in their entirety, you must immediately cease all use of Team Summit services and disconnect from all Summit-controlled systems.

Failure to read these Terms does not exempt you from compliance. Ignorance of these provisions will not be accepted as a defense in any enforcement action.

2. Eligibility & Account Requirements

2.1 Age Requirements

You must meet the following minimum age requirements to use Team Summit services:

  • You must be 13 years of age or older (in compliance with Discord's Terms of Service and COPPA requirements)
  • If you are under 18 years of age, you must have parental or guardian consent to use these services
  • Users must comply with all applicable local age restrictions and data protection laws

2.2 Account Security

You are solely responsible for:

  • Maintaining the security and confidentiality of your Discord account credentials
  • All activities that occur under your account
  • Immediately notifying Team Summit of any unauthorized use of your account

2.3 Organizational Representation

If you are using Team Summit services on behalf of an organization, team, or entity, you represent and warrant that you have the legal authority to bind that organization to these Terms.

3. User Conduct & Behavioral Standards

Team Summit maintains a zero-tolerance policy for the following behaviors:

  • Harassment: Any form of targeted harassment, bullying, stalking, or intimidation of other users
  • Hate Speech: Discriminatory language, slurs, or content targeting race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
  • Exploitation: Attempting to exploit, manipulate, or take advantage of other users
  • Bot Command Abuse: Spamming commands, attempting to overload systems, or misusing Spectra Bot functionality
  • Circumvention: Attempting to bypass, disable, or interfere with security measures, moderation systems, or automated safeguards
  • Impersonation: Falsely representing yourself as another user, Team Summit staff, or affiliated personnel
  • Illegal Activity: Using Team Summit services to facilitate, coordinate, or promote illegal activities

Automated Enforcement

Spectra Bot is authorized to automatically detect, flag, and enforce violations of these conduct standards. Automated enforcement actions may include warnings, temporary restrictions, or permanent bans without prior human review.

4. Intellectual Property & Brand Protection

4.1 Exclusive Ownership

Team Summit retains exclusive, worldwide, perpetual ownership of all intellectual property rights in and to:

  • The Team Summit name, logo, branding, visual identity, color schemes, and design elements
  • The Spectra Bot name, codebase, architecture, command structure, logic, responses, algorithms, and all associated systems
  • Discord server layouts, workflows, role hierarchies, channel structures, and proprietary organizational configurations
  • All documentation, guides, training materials, and content produced by Team Summit
  • All trademarks, service marks, and trade dress associated with Team Summit

4.2 Strictly Prohibited Activities

Zero Tolerance - IP Violations

The following activities are strictly prohibited and will result in immediate legal action:

  • Rebranding, white-labeling, or creating derivative versions of Spectra Bot
  • Copying, replicating, or imitating Team Summit server layouts, structures, or organizational systems
  • Creating "look-alike" bots, platforms, or services that imitate Spectra Bot functionality or appearance
  • Misrepresenting affiliation with, endorsement by, or sponsorship from Team Summit
  • Using Team Summit branding, logos, or intellectual property without explicit written authorization
  • Attempting to register trademarks, domain names, or social media handles confusingly similar to Team Summit

4.3 Active Brand Defense

Team Summit maintains an active brand protection program. We have previously issued Cease and Desist notices and pursued legal remedies against unauthorized use of our intellectual property. We will continue to aggressively defend our brand rights through all available legal channels.

5. Prohibited Technical Activities

Users are strictly prohibited from engaging in the following technical activities:

  • Reverse Engineering: Attempting to reverse engineer, decompile, disassemble, or derive source code from Spectra Bot
  • Data Scraping: Automated scraping, harvesting, or extraction of data from Team Summit systems
  • Behavioral Analysis: Systematically analyzing Spectra Bot responses to replicate functionality
  • Stress Testing: Conducting load tests, penetration tests, or security assessments without prior written authorization
  • API Abuse: Accessing undocumented APIs, endpoints, or backend services
  • Automation Abuse: Using scripts, bots, or automated tools to interact with Team Summit services in unauthorized ways
  • Data Logging: Recording, logging, or storing interaction data beyond approved personal use
  • Exploit Development: Discovering, developing, or distributing exploits, vulnerabilities, or security bypasses

Responsible Disclosure

If you discover a security vulnerability or technical issue, you must report it immediately to Team Summit through official channels. Public disclosure or exploitation of vulnerabilities is prohibited and will result in legal action.

6. Service Availability & Modification Rights

6.1 No Uptime Guarantees

Team Summit provides all services on an "AS IS" and "AS AVAILABLE" basis. We make no guarantees, warranties, or representations regarding:

  • Service uptime, availability, or reliability
  • Feature permanence or continued functionality
  • Response times or performance benchmarks
  • Compatibility with third-party platforms or services

6.2 Unrestricted Modification Rights

Team Summit reserves the unrestricted right to:

  • Modify, update, or remove Spectra Bot features at any time without notice
  • Suspend services temporarily or permanently for maintenance, updates, or operational reasons
  • Discontinue specific functionality, commands, or integrations
  • Change server structures, role hierarchies, or organizational systems
  • Implement new restrictions, requirements, or limitations

6.3 Planned & Unplanned Outages

Services may be interrupted due to:

  • Scheduled maintenance and updates
  • Technical failures or infrastructure issues
  • Third-party platform outages (including Discord API disruptions)
  • Security incidents or abuse mitigation
  • Force majeure events beyond our control

6.4 Network Delivery Dependencies

Team Summit website traffic is delivered through Cloudflare network services, including Cloudflare Tunnel and edge security systems. Service availability may also depend on TLS certificate validity, DNS propagation, and upstream hosting/network conditions.

6.5 Payments & Billing (Stripe)

Where Team Summit offers paid products or services, payment processing is provided by Stripe. By making a payment, you agree to Stripe's applicable terms and privacy practices in addition to these Terms.

  • Payment card data is processed directly by Stripe and is not stored in full by Team Summit.
  • You authorize charges for the selected service, applicable taxes, and any clearly disclosed fees at checkout.
  • Refunds, disputes, and chargebacks are handled according to the applicable purchase terms, these Terms, and Stripe network rules.
  • Team Summit may suspend or limit paid services for failed, reversed, or disputed payments.

7. Disclaimers & Limitation of Liability

7.1 Service Disclaimers

AS IS / AS AVAILABLE

ALL TEAM SUMMIT SERVICES, INCLUDING SPECTRA BOT, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7.2 Limitation of Liability

Team Summit, its operators, contributors, and affiliates shall NOT be liable for:

  • Data Loss: Loss of user data, messages, configurations, or settings
  • Moderation Errors: False positives, incorrect enforcement actions, or missed violations
  • Automated System Failures: Malfunctions in Spectra Bot logic, commands, or automated processes
  • Third-Party Failures: Discord API outages, rate limits, or platform changes
  • Service Interruptions: Downtime, performance degradation, or feature unavailability
  • User Disputes: Conflicts, disagreements, or interactions between users
  • Consequential Damages: Indirect, incidental, special, or consequential damages arising from service use

7.3 Maximum Liability Cap

In no event shall Team Summit' total aggregate liability exceed the greater of $0 USD or the total amount you paid to Team Summit for the specific paid service in the 12 months preceding the claim, except where a different limit is required by applicable law.

8. Enforcement, Suspension & Termination

8.1 Enforcement Authority

Team Summit reserves the absolute and unrestricted right to:

  • Suspend or terminate user access immediately and without prior notice
  • Revoke permissions, roles, or privileges within Team Summit systems
  • Permanently ban users or servers from all Team Summit services
  • Report violations to Discord, law enforcement, or other authorities
  • Pursue legal action, including injunctive relief and monetary damages

8.2 Enforcement Triggers

Enforcement actions may be triggered by:

  • Violations of these Terms of Service
  • Violations of the Team Summit Privacy Policy
  • Behavioral misconduct or community disruption
  • Technical abuse or system exploitation
  • Intellectual property violations
  • Suspected fraudulent or malicious activity
  • Automated detection by Spectra Bot security systems

8.3 No Appeal Guarantee

While Team Summit may provide appeal mechanisms at its discretion, there is no guaranteed right to appeal enforcement decisions. All enforcement determinations are final and binding.

Legal Escalation

Violations of intellectual property protections, terms circumvention, or malicious activities may result in formal legal action, including but not limited to cease and desist notices, DMCA takedowns, trademark enforcement, and civil litigation.

9. Governing Law & Jurisdiction

9.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States of America and applicable international laws, without regard to conflict of law principles.

9.2 Jurisdiction & Venue

You agree that any legal action or proceeding arising from these Terms shall be brought exclusively in courts of competent jurisdiction, and you hereby consent to the personal jurisdiction of such courts.

9.3 Dispute Resolution

Before initiating formal legal proceedings, parties agree to attempt good-faith informal resolution of disputes. However, Team Summit reserves the right to seek immediate injunctive relief for intellectual property violations or terms circumvention.

9.4 Class Action Waiver

You agree to bring claims against Team Summit only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

10. Amendments & Continued Use

10.1 Modification Rights

Team Summit reserves the right to modify, update, or replace these Terms of Service at any time, for any reason, without prior notice.

10.2 Notification of Changes

Updated Terms will be posted with a revised "Last Updated" date. Continued use of Team Summit services after Terms modifications constitutes acceptance of the updated Terms.

10.3 User Responsibility

It is your responsibility to review these Terms periodically. Team Summit is not obligated to provide individual notification of Terms changes.

10.4 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
